Amendments made to the Communiqué on Non-Fuel Petroleum Products

Amendments have been made to the Communiqué on the Procedures and Principles of Supplying Non-Fuel Petroleum Products from Domestic and Foreign Resources. The resolution of the Energy Market Regulatory Authority concerning the issue was published in the Official Gazette. According to the resolution, non-fuel petroleum products that the industrialists provide for production and the importers provide on behalf of producers will not be received from third parties without EMRA’s permission. The unused part of the letters of conformity of the companies, the lubricant licenses of which have been terminated or abolished, will be canceled by the Office. In case there is any noncompliance in the documents submitted to the institution or there is a need to examine the application in detail, additional information and documents may be requested from the applicant. In case of any contradiction found in the examination and evaluation processes with regard to the relevant and other legislation and/or in case of strong suspicion in this matter, the Department of Inspection and/ or competent authorities shall be informed. If the institution launches a preliminary investigation or prosecution, a cautionary judgement can be imposed by the consent of the Presidency upon the proposal of the Department to prevent the submission of the letter of conformity to the addressee throughout the investigation. In case of any contradiction in the relevant and other legislation during the examination and evaluation processes or in case of strong suspicion in this matter, the Department of Inspection or competent authorities shall be informed. Besides, in the context of the transitional article, any restrictions imposed in the event of determination of contradiction or of strong suspicion before the date on which the article enters into force, the restrictions may be lifted without any other resolution
